Terms of Service

1. Acceptance and Eligibility

By creating an account or using TrendWarz, you agree to these Terms of Service and our Privacy Policy. These Terms form a binding legal agreement between you and TrendWarz.

• You have the legal capacity to enter into these Terms
• You are not prohibited from using the service under applicable law
• You will use TrendWarz only for lawful purposes
• If you are a parent/guardian approving a teen account, you accept responsibility for monitoring your teen's use of TrendWarz

2. Restricted Teen Accounts (Ages 13-17)

Users aged 13-17 receive restricted accounts by default with enhanced safety protections. These restrictions cannot be disabled and are designed to protect minors from inappropriate content and interactions.

3. Parental Controls and Rights

Parents and guardians of teen users (ages 13-17) have the following rights and controls:

• Request an activity report showing their teen's account usage, battles posted, and votes cast
• Request additional restrictions beyond the default teen account protections
• Deactivate or delete their teen's account at any time by emailing support@trendwarz.com
• Update their contact information on file
• Report concerns about their teen's account or interactions with other users

All parental requests are processed within 72 hours. Use the subject line "Parental Request" for priority handling.

4. Your Content and License

You retain full ownership of all content you upload, post, or share on TrendWarz, including videos, images, captions, and any other materials (Your Content).

By uploading content to TrendWarz, you grant TrendWarz a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

• Host, store, and serve Your Content on our platform
• Display, transmit, and distribute Your Content to other users
• Adapt or reformat Your Content for technical delivery purposes
• Use Your Content to promote TrendWarz, including in marketing materials

This license exists only to operate and improve the TrendWarz service. You confirm that you own or have the necessary rights, licenses, and permissions to upload Your Content and to grant TrendWarz this license.

5. Battle Videos and Paired Content (Important)

TrendWarz is built around head-to-head video battles. When two creators are matched in a battle, their videos become paired content.

• The video contains content that violates our Prohibited Content policy (Section 6)
• The video was uploaded without your authorization (account was compromised)
• The video contains personally identifiable information that creates a safety risk
• There is a valid copyright claim with supporting documentation
• A court order or law enforcement request requires removal
• A parent/guardian requests removal of their teen's video (for users aged 13-17)

TrendWarz will review paired video removal requests within 72 hours. Requests motivated by dissatisfaction with battle results will be denied. Losing a battle is not grounds for video removal.

6. Prohibited Uses

You agree not to upload, post, or share content that:

• Contains hate speech or discrimination targeting protected groups
• Harasses, bullies, threatens, or intimidates any person
• Encourages or glorifies self-harm, suicide, or eating disorders
• Contains nudity, pornography, or sexually explicit material
• Depicts or promotes illegal activity
• Infringes the intellectual property rights of others
• Contains spam, misleading information, or coordinated inauthentic behavior
• Uses deepfakes or AI-generated content to impersonate real people without consent
• Constitutes dangerous challenges that could cause physical harm
• Attempts to breach the security or integrity of the platform
• Harvests user data or engages in phishing
• Doxxes or exposes private information of others
• Targets, exploits, or inappropriately contacts minors

Violations may result in content removal, account suspension, or permanent ban without notice. Violations involving minors will result in immediate account termination and may be reported to law enforcement.

7. Designed for Discrete Sessions

TrendWarz is designed for discrete competitive sessions, not prolonged continuous use. Each battle has a defined voting period with a clear start and end time. We encourage users to:

• Vote on battles where you have context to make an informed judgment
• Return when new relevant battles are available in your preferred categories
• Use the optional screen time reminders to monitor your usage (mandatory for teen accounts)
• Take breaks between voting sessions

TrendWarz provides optional screen time tools for all users and mandatory screen time reminders for teen accounts (ages 13-17) to support healthy usage patterns.

8. Battles, Votes, and Rankings

• Battle outcomes are determined by community votes and are final unless fraud is detected
• TrendWarz may adjust, correct, or reverse outcomes in cases of fraud, vote manipulation, technical errors, or policy violations
• Rankings and leaderboard positions may change at any time
• TrendWarz may modify, discontinue, or alter any competitive features at any time
• Participating in a battle means you accept both the possibility of winning and losing

9. Copyright and Intellectual Property

If you believe content on TrendWarz infringes your copyright, send a takedown request to support@trendwarz.com including:

• Your full name and contact information
• A description of the copyrighted work you claim has been infringed
• The URL or location of the allegedly infringing content on TrendWarz
• A statement that you have a good faith belief the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on their behalf

Copyright takedown requests for paired battle videos are subject to the rules in Section 5. We respond to all copyright requests within 72 hours.

10. Moderation and Account Actions

TrendWarz reserves the right to:

• Remove any content that violates these Terms without prior notice
• Suspend or terminate accounts that repeatedly violate these Terms
• Preserve and share information with law enforcement when required by applicable law or to protect user safety
• Take action on accounts that attempt to manipulate votes, rankings, or battle outcomes
• Remove accounts that target, harass, or inappropriately contact minors
• Immediately terminate accounts of users who lie about their age or bypass age restrictions

Moderation decisions involving teen accounts or child safety violations are final and not subject to appeal.

11. Payments and Purchases

TrendWarz is currently free to download and use. Any future paid features, in-app purchases, or subscriptions will be clearly disclosed before any charge is made. Users under 18 cannot make purchases without verified parental consent. All payments processed through the Apple App Store or Google Play Store are subject to their respective terms and refund policies. TrendWarz does not store payment information directly.

12. Safety and Reporting

Use the built-in reporting tools to flag content that violates these Terms. Reports involving minors or child safety concerns receive priority review and are processed within 24 hours. If you encounter imminent physical danger, contact your local emergency services immediately.

13. Privacy and Data

We process your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. Teen accounts (ages 13-17) receive enhanced privacy protections including minimal data collection, no behavioral advertising, restricted data sharing, and parental access rights. 14. Disclaimers and Liability

TrendWarz is provided as is and as available without warranties of any kind. To the maximum extent permitted by applicable law, TrendWarz is not liable for indirect or consequential damages arising from your use of the service. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including our obligation to provide a safe environment for minor users.

15. Changes and Termination

We may update these Terms at any time. Material changes will be communicated via in-app notification or email. For changes affecting teen accounts or parental rights, we will obtain renewed parental consent where required by law. Continued use of TrendWarz after changes are posted constitutes your acceptance.

16. Governing Law and Disputes

These Terms are governed by applicable local consumer rights and mandatory laws in your jurisdiction. We encourage you to contact support@trendwarz.com to attempt an informal resolution before pursuing formal legal action.
