Terms of Service

1. Who we are and what this is

TrendWarz ("TrendWarz", "we", "us") is operated by Laura Gachanja, a sole trader based in Nairobi, Kenya, contactable at support@trendwarz.com. These Terms are a binding agreement between you and the operator. By creating an account or using TrendWarz, you agree to them. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be at least 13 years old to use TrendWarz. If you are between 13 and 17, you may only use TrendWarz with the involvement of a parent or guardian, and we will ask for a parent or guardian's email address so we can seek their consent; until that consent is given your account remains in a limited teen experience. If you are under 13 you may not create an account, and we will remove accounts we learn belong to under-13s. Some regions set a higher minimum digital-consent age; where that applies to you, you must meet it. You are responsible for keeping your login credentials secure and for activity that happens through your account, and you agree to tell us promptly at support@trendwarz.com if you believe your account has been compromised.

3. Your content and the licence you give us

You keep ownership of content you upload. You give TrendWarz a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, cache, process, reproduce, adapt for formatting and delivery, display, distribute, and moderate that content, only as needed to operate, secure, improve, and promote the service. This licence ends when you delete the content or your account, except that copies may persist for a limited period in backups, caches, and safety or legal records, and except where the content has been shared onward by others in a way we cannot recall. You confirm you have the rights to everything you upload, including any music, footage, trademarks, or other people appearing in it.

4. Community rules

You may not upload or share unlawful, infringing, deceptive, hateful, sexually exploitative, abusive, violent, or spam content, attempt to manipulate votes, scrape the service, reverse engineer protected systems, or use bots or automated account creation without written permission. Content involving minors in a sexualised way is prohibited absolutely and will be reported to the relevant authorities.

5. Moderation and enforcement

TrendWarz may review, remove, restrict, age-gate, or report content or accounts when we believe it is necessary to enforce these Terms, comply with law, protect users, or protect the service. We are not obliged to monitor content proactively, and we do not endorse any user content. Where practical we will tell you why an action was taken and how to appeal by contacting support@trendwarz.com.

6. Copyright, and how to report infringement

TrendWarz respects intellectual property rights. If you believe content on TrendWarz infringes your copyright, our full notice-and-takedown procedure — including our designated agent, the counter-notification process, and our repeat-infringer policy — is set out in our DMCA & Copyright Policy at trendwarz.com/dmca. We terminate the accounts of repeat infringers in appropriate circumstances.

7. Platform features

Battles, rankings, messages, notifications, and other features may change, be interrupted, or be discontinued. We do not guarantee availability, performance, or preservation of any metric, vote total, or placement. Battle outcomes are determined by community votes; we do not guarantee any particular result and vote totals may be adjusted where we detect manipulation.

8. Account suspension and deletion

You may stop using TrendWarz at any time and can delete your account from within the app. We may suspend, limit, or terminate access if we reasonably believe you violated these Terms, created risk for other users, or exposed the service to abuse or legal liability. Sections that by their nature should survive termination — including sections 3, 9, 10, 11, 12, 13, and 15 — continue to apply after your account ends.

9. Disclaimers

TrendWarz is provided on an as-is and as-available basis to the maximum extent permitted by law. We disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service, error-free operation, or that user content will always be available. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

10. Limitation of liability

To the maximum extent permitted by law, TrendWarz and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for loss of data, content, reputation, goodwill, or business arising from use of the service. To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the service or these Terms will not exceed the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars (US$50). These limits apply regardless of the legal theory and even if we were advised the loss was possible.

11. Indemnity

You agree to indemnify and hold harmless TrendWarz and its operator from any claim, demand, loss, liability, or expense (including reasonable legal fees) brought by a third party and arising out of content you upload, your use of the service, your breach of these Terms, or your violation of any law or of anyone else's rights. We will notify you of any such claim and you may control the defence, provided you do not settle it in a way that imposes any obligation on us without our written consent.

12. Governing law

These Terms and any dispute arising out of or relating to them or the service are governed by the laws of the Republic of Kenya, without regard to conflict-of-laws rules. Subject to section 13, you and we submit to the exclusive jurisdiction of the courts of Nairobi, Kenya. If you are a consumer resident elsewhere, this does not deprive you of the protection of any mandatory consumer-protection rules of your country of residence.

13. Dispute resolution and class-action waiver

Before starting formal proceedings, you agree to contact us at support@trendwarz.com and give us 30 days to resolve the dispute informally. If it is not resolved, any dispute will be referred to and finally settled by arbitration by a single arbitrator under the Arbitration Act No. 4 of 1995 of Kenya, with the seat of arbitration in Nairobi and the proceedings conducted in English. Either party may instead bring an individual claim in a small-claims or equivalent court if the claim qualifies. To the maximum extent permitted by law, disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding; the arbitrator may not consolidate more than one person's claims. If this class-action waiver is held unenforceable as to a particular claim, that claim is severed and heard in court, and the remainder of this section still applies.

14. App stores

If you obtained TrendWarz from the Apple App Store: these Terms are between you and the operator only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support, and if the app fails to conform to any applicable warranty you may notify Apple, which may refund the purchase price; to the maximum extent permitted by law Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product-liability, legal-compliance, or intellectual-property claims. You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you obtained TrendWarz from Google Play, Google's terms apply to that distribution in the same spirit.

15. General

If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them to a successor in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, Community Guidelines, and DMCA & Copyright Policy, are the entire agreement between you and us about the service and replace any prior understanding. We are not liable for failure to perform caused by events beyond our reasonable control. We may give you notices in-app, by email to your registered address, or by posting on trendwarz.com.

16. Changes and contact

We may update these Terms to reflect product, legal, or safety changes. Material updates will be communicated in-app or by email before they take effect where reasonably possible, and the date at the top of this page will change. Continuing to use TrendWarz after an update means you accept the revised Terms. Questions can be sent to support@trendwarz.com.
